律所回复了 The I797 notice will be issued with 3 year validity. The I94 at the bottom of the page will match the record number of your I94 from your last entry to the US and indicate the end validity date of the H1B plus a ten day grace period. If you depart and then reenter the US with the current passport, an I94 will be issued that matches the end date on your passport.

我的护照有效期就剩一年不到，入境也给到797 过期日了，超过护照有效期
这其实是错给了。以前组里还有人遇到过，错给超过了护照时间，但是没给足 I-797 的时间。过了好久换了护照以后，因为不想延期，找 CBP 去 “fix error”，然后 CBP 直接给他 backdate 到了入境时候护照过期 减六个月，直接 unlawful presence 了大半年了 还好后来 NPT 救回来了
去年入境的时候护照还剩一年多一点 i94给了三年

不知道。。 但你看楼里都不止我一个这样的可能ymmv了 不过我已经换了护照又重新入境过了所以没法验证了
我觉得你只要不去找 CBP 改，都是安全的。只要离境了再回来，就更没理由去翻旧账了

会超过你的护照有效期的。但你不要出境。出境的话，海关就给你到护照有效期，而且以最后一次给的日子为准，你这时候如果只看I-797就会入坑了。
